2. Description of Service

Advisor Stack is an informational directory of AI-powered software tools for financial advisors and financial planners. We provide:

• Curated listings of AI tools across 9 categories (portfolio management, financial planning, tax optimization, CRM, compliance, retirement, estate planning, lead generation, AI assistants)
• Tool descriptions, features, pricing information, and categorization
• Links to official vendor websites
• Editorial content, comparisons, and educational resources
• Search, filter, and sort functionality

We are NOT: a software vendor, financial advisor, broker-dealer, investment adviser, or marketplace. We do not sell software, process transactions, provide financial advice, endorse specific tools, or guarantee outcomes.

Advisor Stack is supported by affiliate marketing and advertising. This disclosure complies with FTC guidelines:

• Affiliate Links: Some outbound links to tool vendors contain affiliate tracking codes. If you click and subsequently purchase, we may earn a commission at no additional cost to you.
• AdSense Advertising: We display Google AdSense advertisements. Ad content is determined by Google based on your browsing history and site content.

Third-Party Content: Tool names, logos, trademarks, screenshots, and vendor descriptions belong to their respective owners. We use them under fair use for identification and comparison purposes, or with permission where applicable.

Permitted Use: You may access and view content for personal, non-commercial informational purposes. You may not:

• Scrape, crawl, or programmatically extract data (including via bots, spiders, scrapers, or APIs)

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• Advisor Stack, its owners, officers, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, business opportunities, goodwill, or reputation
• Our total aggregate liability for any claims arising from these Terms or your use of the Site shall not exceed $100 USD or the amount you paid us (if any), whichever is greater
• We are not liable for: vendor actions, third-party site content, financial decisions based on our content, service interruptions, data loss, or unauthorized access

Some jurisdictions do not allow limitation of liability for certain damages; the above may not apply to you to the extent prohibited by law.

11. Indemnification

You agree to indemnify, defend, and hold harmless Advisor Stack and its owners, officers, employees, and affiliates from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from:

• Your violation of these Terms
• Your misuse of the Site or its content
• Your violation of any third-party rights (IP, privacy, etc.)
• Any financial decisions you make based on Site content

12. Dispute Resolution

12.1 Informal Resolution

Before initiating any formal proceeding, you agree to attempt good-faith informal resolution by contacting us at [email protected] with a description of the dispute and proposed resolution.

12.2 Binding Arbitration (US Residents)

If informal resolution fails and you are a US resident, any dispute shall be resolved by binding individual arbitration administered by JAMS under its Streamlined Arbitration Rules, conducted in English, in the state of your residence (or mutually agreed location). The arbitrator's award is final and binding. You may opt out of arbitration within 30 days of first use by emailing [email protected] with "Arbitration Opt-Out" in the subject line.

12.3 Class Action Waiver

All disputes shall be resolved individually, not as class, collective, or representative actions. The arbitrator may not consolidate claims or preside over class proceedings.

12.4 Small Claims Court

Nothing prevents you from bringing qualifying claims in small claims court on an individual basis.

12.5 Governing Law

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict of law principles. For non-US residents, this choice of law does not deprive you of mandatory consumer protections in your jurisdiction.

13. Termination

We may suspend or terminate your access to the Site at any time, with or without cause, including for violations of these Terms. Upon termination, Sections 3, 7, 9, 10, 11, 12, and 14 survive.

14. Changes to Terms

We may modify these Terms at any time. The "Last updated" date at the top reflects the current version. Material changes will be posted on the homepage or via email (if we have your contact info). Continued use after changes constitutes acceptance. If you disagree with changes, your sole remedy is to stop using the Site.

15. General Provisions

• Entire Agreement: These Terms, Privacy Policy, and any incorporated policies constitute the entire agreement
• Severability: If any provision is unenforceable, the remainder remains in effect
• No Waiver: Failure to enforce a right does not waive it
• Assignment: We may assign these Terms; you may not assign without our written consent
• No Third-Party Beneficiaries: These Terms benefit only the parties
• Force Majeure: Not liable for delays due to events beyond our control
